Terms of Service

Thank you for using Experimentally.ai ("we," "us," "our"). These Terms of Use ("Terms") govern your use of Experimentally.ai, its website, software, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.

1. Who We Are

Experimentally.ai ("Experimentally," "we," or "our") is a technology service that uses large language model (LLM) technologies, including Anthropic's Claude, to assist users in summarizing scientific and technical materials. Our mission is to help researchers and organizations distill scientific information efficiently while maintaining appropriate confidentiality safeguards.

2. Registration and Access

a. Eligibility

You must be at least 18 years old to use the Service. The Service is intended for use by academic institutions, research organizations, and corporate entities in scientific and technical fields.

b. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

c. Organizational Accounts

If you register with an email domain owned by your employer or organization, that organization may assume control of your account. In such cases, your organization's administrator will be able to access and manage account data.

3. Use of the Service

a. Permitted Use

Subject to these Terms, you may use the Service to upload scientific materials and receive AI-generated summaries. You must comply with all applicable laws and regulations in your use of the Service.

b. Prohibited Uses

You may not:

  • Use the Service to develop or train competing AI models.
  • Upload materials you do not have the legal right to use.
  • Attempt to reverse engineer or access the underlying LLM technology.
  • Use the Service for any illegal, harmful, or abusive activity.
  • Circumvent rate limits or technical restrictions.

4. Confidentiality and Data Handling

Experimentally.ai does not retain, view, or store user-uploaded materials ("Inputs") or generated summaries ("Outputs"). Inputs and Outputs are processed transiently to generate summaries and are deleted automatically after processing.

You are solely responsible for ensuring that any data you upload complies with your organization's confidentiality, data protection, or publication policies.

5. Content and Intellectual Property

a. Ownership

You retain ownership of all Input you provide. To the extent permitted by law, you own all Output generated for you by the Service.

b. Third-Party Providers

Our Service relies on third-party LLM providers (such as Anthropic's Claude) to generate summaries. Anthropic and other providers have no direct relationship with you and are not responsible for your use of the Service or the accuracy of Outputs.

c. Feedback

You grant Experimentally.ai a perpetual, royalty-free license to use any feedback or suggestions you voluntarily provide for improving the Service.

6. Accuracy and Use of Outputs

a. Accuracy Disclaimer

The summaries generated by Experimentally.ai are automated and may contain inaccuracies, omissions, or misleading interpretations. While the Service aims to assist in understanding scientific materials, you are solely responsible for verifying the accuracy and appropriateness of all Outputs before relying on or sharing them.

b. No Clinical or Regulatory Reliance

Outputs are not reviewed, validated, or approved for clinical, regulatory, or safety-related use. You must not rely on the Service for any purpose that could affect patient care, regulatory submissions, compliance reporting, or other legally or materially significant decisions without proper review.

c. Responsibility for Use

You agree that Experimentally.ai shall not be liable for any loss, error, or decision arising from your use or reliance on Outputs, and you use the Service at your own risk.

7. Paid Accounts and Billing

a. Subscription Model

Access to the Service is offered on a monthly subscription basis. Subscription fees are charged automatically via your chosen payment method at the start of each billing period.

b. Taxes and Refunds

You are responsible for all applicable taxes. Payments are non-refundable, except as required by law.

c. Price Changes

We may modify subscription pricing with at least 30 days' notice before the new rates apply. If you do not agree, you may cancel your subscription before the next renewal.

d. Cancellation

You may cancel your subscription at any time. Access remains active through the end of the current billing period.

8. Termination

We may suspend or terminate your access to the Service if:

  • You breach these Terms;
  • Your use poses a security or legal risk; or
  • We are required to do so by law.

You may terminate your account at any time by contacting info@experimentally.ai. Upon termination, access will cease and all active sessions will be closed.

9. Disclaimers and Limitation of Liability

a. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. EXPERIMENTALLY.AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

b. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPERIMENTALLY.AI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF DATA OR PROFITS.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (1) THE AMOUNT YOU PAID DURING THE 12 MONTHS PRIOR TO THE CLAIM, OR (2) ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold harmless Experimentally.ai, its affiliates, and personnel from any third-party claims, damages, or expenses (including attorneys' fees) arising out of your use of the Service, your Content, or your violation of these Terms.

11. Arbitration and Dispute Resolution

a. Informal Resolution

Before pursuing arbitration, you agree to attempt to resolve any dispute informally by contacting us at info@experimentally.ai. We will attempt to resolve disputes within 60 days.

b. Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service shall be resolved by final and binding arbitration administered by National Arbitration and Mediation (NAM) under its rules. The arbitration shall take place by videoconference or, if in-person, in California. The Federal Arbitration Act (FAA) governs this section.

c. Class Action Waiver

Disputes must be resolved on an individual basis. Class, collective, or representative proceedings are not permitted.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Except as provided in the arbitration clause, all claims shall be heard in the state or federal courts of California.

13. Changes to These Terms

We may update these Terms periodically. If we make material changes that adversely affect you, we will provide at least 30 days' notice via email or in-product notification. Continued use after updates constitutes acceptance of the revised Terms.

15. Entire Agreement

These Terms constitute the entire agreement between you and Experimentally.ai regarding use of the Service and supersede any prior agreements or understandings.
